These terms are an agreement between you and Smart Coders LLC ("RydPal", "we"), 17 Comiso, Irvine, California 92614. By using the RydPal apps or websites you accept them.
RydPal is a technology platform that connects riders with independent drivers. We do not own vehicles and we do not employ drivers. Drivers are independent contractors who decide when and whether to drive and whether to accept any request.
You must be 18 or older to ride, and 21 or older with a valid licence, insurance, an eligible vehicle and a passed background check to drive. One account per person. Accounts may not be shared, sold or transferred.
During the pilot, fares may be paid in cash to the driver where the city settings allow it. When card payments are introduced, you authorise us to charge your saved payment method for fares, tips and any fee described in these terms.
Do not use RydPal to break the law, harass or endanger anyone, or carry anything illegal. Drivers and riders may refuse or end a trip if they feel unsafe. RydPal has a zero-tolerance policy for drugs and alcohol: report a driver you believe is impaired and we will investigate and may remove them from the platform. We may suspend or close an account that breaks these rules.
Drivers are responsible for their own vehicle, licence, registration, inspections and taxes, and for keeping insurance that meets state requirements. Documents must be current; we may deactivate an account whose documents expire. Earnings are the fare less the platform fee shown in your app, plus tips.
RydPal maintains the commercial insurance required of transportation network companies in the states where it operates. Coverage depends on the stage of the trip. Your own policy may not cover driving for hire; check with your insurer.
We provide the service as it is. We do not promise it will always be available, that a driver will always be found, or that estimated times will be exact. Maps and estimates come from OpenStreetMap data and may be imperfect.
To the extent the law allows, RydPal is not liable for indirect, incidental or consequential damages, and our total liability for any claim relating to a trip is limited to the amount you paid for that trip. Nothing here limits liability that cannot be limited by law, including for death or personal injury caused by negligence.
Contact support@rydpal.com first; most issues are settled quickly. These terms are governed by the laws of the State of California, without regard to conflict of law rules.
We may update these terms. If a change is significant we will tell you in the app before it takes effect. Continuing to use RydPal after that means you accept the new terms.
